NumeRev (hereinafter “we”) uses the security service hCaptcha (hereinafter “hCaptcha”) on its website.
This service is provided by Intuition Machines, Inc., a Delaware corporation (“IMI”).
hCaptcha is used to verify whether user actions on NumeRev (such as submitting a login or contact form) comply with our security requirements.
For this purpose, hCaptcha analyzes the behavior of the website or mobile application visitor based on various characteristics. This analysis begins automatically as soon as the visitor accesses a section of the website where hCaptcha is enabled. For the analysis, hCaptcha evaluates various information (e.g., IP address, the length of time the visitor has been on the website, or mouse movements performed by the user).
The data collected during the analysis will be transmitted to IMI.
hCaptcha analysis in “invisible mode” may take place entirely in the background. Website visitors are not informed that such analysis is taking place if no challenge is presented to the user.
Data processing is based on Art. 6(1)(b) of the GDPR: the processing of personal data is necessary for the performance of a contract to which the website visitor is a party (for example, the General Terms and Conditions of Use of the Website) or in order to take steps at the request of the website visitor prior to entering into a contract. Our online service must ensure that it interacts with a human and not with a bot, and that the activities carried out by the user are not related to fraud or abuse.
Furthermore, processing may also be based on Art. 6(1)(f) of the GDPR: our online service has a legitimate interest in protecting the service against abusive automated scraping, spam, and other forms of misuse that may harm our service or other users of our service.
IMI acts as a “processor” on behalf of its customers as defined under the GDPR, and as a “service provider” for the purposes of the California Consumer Privacy Act (CCPA).
