Terms of service

The following General Terms of Use (hereinafter referred to as "GTC") aim to provide a legal framework for the provision of the website and services by the NumeRev platform and to define the conditions for accessing and using the services by the "USER".

The GTC are accessible on the website under the "GTC" section.

Any registration or use of the website implies the unconditional and unrestricted acceptance of these GTC by the USER. During registration on the website via the Registration Form, each USER explicitly accepts these GTC by checking the box preceding the following text: "I acknowledge having read and understood the GTC and I accept them".

In the event of non-acceptance of the GTC stipulated in this agreement, the USER must refrain from accessing the services offered by the website.

NumeRev reserves the right to unilaterally modify the content of these GTC at any time.

Preamble

Open science is the unrestricted dissemination of results, methods, and products of scientific research. It relies on the opportunities provided by the digital transformation to develop open access to publications and—wherever possible—to data, source codes, and research methods.

France has adopted an ambitious policy in favor of open science with the National Plan for Open Science (version 1 in 2018 and version 2 in 2021). This plan aims to integrate French research into the global movement for open data and transparency in public action. Its objectives are:

  • to generalize open access to publications,

  • to structure, share, and open research data,

  • to open and promote source codes produced by research,

  • to transform practices to make open science the default principle.

The NumeRev platform aims to freely and openly disseminate digital scientific resources. NumeRev offers a scientific publishing workflow that enables easy and rapid management of the evaluation and publication process for scientific articles or works.

The NumeRev platform, managed by MSH SUD, fulfills missions to create tools specific to the management of scientific information in all phases of its production and knowledge management tools (collaborative encyclopedia and mapping). The platform also ensures the electronic dissemination and permanent identification of scientific documents (DOI).

The services offered on the NumeRev platform are subject to acceptance of the following General Terms of Use (GTC) described below.

ARTICLE 1: IDENTITY

1.1 The Institution

The publication of the NumeRev website is managed by the Université de Montpellier Paul-Valéry (UMPV), a public institution of a scientific, cultural, and professional nature, SIREN number 193410891, whose headquarters are located at Route de Mende, 34199 Montpellier cedex 05, represented by Ms. Anne FRAÏSSE, its President.

The UMPV, hereinafter referred to as the "INSTITUTION," has been mandated by the Centre national de la recherche scientifique (CNRS) and the Université de Montpellier (UM) to manage the NumeRev platform.

A public institution of a scientific and technological nature, headquartered at 3 rue Michel Ange 75794 PARIS Cedex 16, SIREN number 180 089 013, NAF code 7219Z, represented by its President, Mr. Antoine PETIT, who has delegated his signature for this contract to Mr. Jérôme VITRE, Regional Delegate for the Languedoc-Roussillon delegation (located at 1919, route de Mende, 34293 MONTPELLIER Cedex 5, SIRET number 180 089 013 00395, NAF code 7220Z).

  • UM. A public institution of a scientific, cultural, and professional nature, headquartered at 163 rue Auguste Broussonnet 34090 Montpellier, France, SIRET number 130 020 548 00017, represented by its President, Mr. Philippe AUGE.

The UMPV, CNRS, and UM, acting both in their own names and on behalf of the UAR2035 MSH-SUD, directed by Mr. Olivier TINLAND, hereinafter referred to as "MSH-SUD".

1.2 The Collection

NumeRev disseminates scientific productions in various forms: journal articles, collective works, conference proceedings, research notebooks, data papers... These contents are hereinafter referred to as the "COLLECTION".

1.3 The User

The NumeRev resource portal supports higher education and research publishing centers, publishing houses, and research laboratories in their scientific publishing projects and digital transition.

These GTC apply to registered and logged-in USERS of the platform. A "USER" is defined as any individual who uses the platform's services to edit, review, publish, and disseminate digital content. These resources are subsequently freely accessible on the NumeRev portal.

The website is hosted by PulseHeberg, a Simplified Joint Stock Company whose headquarters are located at 9, Boulevard de Strasbourg, 83000 Toulon, France.

ARTICLE 2: ACCESS TO THE PLATFORM

2.1 NumeRev's Commitments

The INSTITUTION, through the NumeRev service, commits to:

  • Hosting electronic files on the NumeRev platform;

  • Disseminating metadata and the full text of works on the NumeRev platform and partner channels;

  • Assisting content holders in mastering the platform's technical devices and supporting them in complying with the quality charters of scientific publishing;

  • Maintaining IT infrastructures and the sustainability of content within its means. However, it is specified that uninterrupted access to the NumeRev platform is not guaranteed, particularly in the event of maintenance, repairs, or internet connection disruptions. The INSTITUTION cannot be held responsible for technical failures and associated data losses, nor for any other indirect damage occurring during the use of the site or related to it.

  • Ensuring greater visibility for resources disseminated through the NumeRev platform by assigning a DOI (Digital Object Identifier), a permanent and unique identifier, to all scientific articles. The DOI allows referencing, citing, and providing a stable link to an online file.

NumeRev offers the following services:

  • Providing strategic and technical advice and support to publication project holders during the creation and development phases.

  • Implementing semantic editorialization via the tagging model using the Semi-Contextual Approach to Corpora (ASCC), which enables the semantic enrichment of scientific publications.

  • Providing access to and promoting the reuse of research corpora and materials that have contributed to the scientific contribution.

  • An interface for peer review of articles deposited on the platform. In scientific disciplines, peer review refers to the collective activity of researchers who critically evaluate the work of other researchers.

The site is freely accessible from anywhere to any USER with internet access. All costs incurred by the USER to access the service (computer hardware, software, internet connection, etc.) are their responsibility.

Non-member USERS do not have access to reserved services. To do so, they must register by completing the registration form. By agreeing to register for reserved services, the USER commits to providing accurate and truthful information regarding their identity and contact details, particularly their email address. To access the services, the USER must then log in using their username and password.

Any registered USER may also request deregistration by visiting the dedicated page in their personal space. This will take effect within a reasonable timeframe.

Any event due to force majeure resulting in a malfunction of the website or server, and subject to any interruption or modification in the event of maintenance, does not engage the responsibility of the INSTITUTION. In such cases, the USER agrees not to hold the INSTITUTION responsible for any interruption or suspension of service, even without prior notice.

The USER has the option to contact the site by email at the address provided in ARTICLE 1.

2.2 Commitments of the COLLECTION

The publication director of the COLLECTION declares and guarantees that the personal data of the authors, for which they are responsible for processing, are collected and then transmitted to the NumeRev platform in compliance with the provisions of the European General Data Protection Regulation (GDPR).

The publication director of the COLLECTION guarantees the NumeRev platform the possibility to publish and archive the personal data of said authors on the platform.

The COLLECTION commits to:

  • Guaranteeing the INSTITUTION that it holds all the rights necessary to fulfill its obligations under these GTC. If it is not the owner, it guarantees that it is expressly authorized by the rights holders to grant all the rights ceded to the INSTITUTION without incurring any prohibition and/or sanction.

  • Informing the INSTITUTION as soon as possible of the exercise by one of the authors of their right of withdrawal affecting the terms or rights of dissemination by the INSTITUTION of the COLLECTION, in whole or in part.

  • Allowing the INSTITUTION to disseminate content freely and without any financial compensation for either the authors or the readers.

  • Systematically providing all the metadata necessary for the proper functioning of the dissemination platform. It is specified that metadata is information describing the published documents, such as the title, subtitle, abstract, author, table of contents, ISBN/ISSN, publication language, keywords, etc.

  • Ensuring the final quality control of the content transmitted to the INSTITUTION in accordance with the quality charters of scientific publishing in force to allow the referencing of the collection in national and international scientific databases:

    • Ensuring that the content of the disseminated corpora complies with ethics and scientific integrity;

    • Ensuring that editorial/redactional standards comply with those specified on the COLLECTION's website on the NumeRev platform and carrying out editorial validation in parallel with the documentary and promotional work ensured by NumeRev;

    • Controlling the language level of the disseminated corpora and publishing content whose form complies with the practices of the academic community;

    • Not disseminating content contrary to laws and regulations in force, particularly of a racist, xenophobic, discriminatory, malicious, insulting, defamatory, hateful, pornographic, violent nature, or infringing on privacy, the rights of third parties, or commercial secrets or confidential information;

  • Requesting an ISSN number from the BNF and notifying them of any changes.

  • Indicating, on the site dedicated to the COLLECTION on the NumeRev platform, the governance of the project (editorial committee, scientific committee, and review committee) and specifying the status and affiliation of its members.

  • Publishing at least one corpus of articles per year (between 6 and 12 articles per corpus for COLLECTIONS or collective works).

  • Having articles peer-reviewed while respecting the non-affiliation between author and reviewer and indicating the evaluation procedure on a page of their dedicated site on the NumeRev platform.

  • Providing the necessary information to identify the authors (status, affiliation, and institutional addresses).

  • Accompanying original articles with abstracts and keywords in French and English (at least).

  • Participating in and contributing to the NumeRev platform's tagging experiments on its corpora.

  • Informing the INSTITUTION of any ongoing partnership files on other scientific publishing platforms (OpenEdition, Cairn, etc.) or in electronic bookstores.

ARTICLE 3: PERSONAL DATA PROTECTION

The INSTITUTION ensures that the USER's personal information is collected and processed in compliance with privacy rights, in accordance with the provisions of the French "Informatique et Libertés" law of January 6, 1978, and in compliance with the European General Data Protection Regulation (GDPR), which came into force on May 25, 2018.

It is also specified that the NumeRev platform is hosted by PulseHeberg. The conditions applicable to the hosting of NumeRev by PulseHeberg are available at the following URL: https://pulseheberg.com/fr/company/legal-notice

The NumeRev platform performs automated processing of your personal data, particularly during registration in a context requiring the collection of this personal data.

  • Data Controller: The data controller is the INSTITUTION.

  • Legal basis for processing: The processing of personal data is necessary for the performance of a task carried out in the public interest.

    • The processing of this data will enable the NumeRev platform to carry out, in a relevant and appropriate manner, the mission with which it is entrusted. As a research-action program, NumeRev aims to study the practices related to scientific publishing within research communities and to explore the possibilities offered by digital technology to increment, renew, or design technologies adapted to their needs and uses.

    • The public service mission is therefore to contribute to scientific production.

3.1 Processing and Purposes

The purposes of this processing are as follows: completing the records created by the INSTITUTION for the purpose of publishing publications on the NumeRev platform, their indexing, referencing, and the production of statistical indicators between the COLLECTION and the INSTITUTION.

The collected data concerns professional identification and professional contact details of individuals, namely:

  • Data collected during the creation of a USER account: last name, first name, email, current and/or past affiliation (position(s), institution(s), date(s)), researcher identifiers (HAL, ORCID, IDRef, Research Gate, Twitter). Researcher identifiers are optional.

  • Data collected during the publication of articles: last name, first name, email, current and/or past affiliation (position(s), institution(s), date(s)), researcher identifiers (HAL, ORCID, IDRef, Research Gate, Twitter), discipline(s), and research keywords. Researcher identifiers are optional.

  • Data provided during registration for peer review activities. This information is collected for the following purposes:

    • Creating a list of reviewers made available to publishing managers.

    • Contacting reviewers to organize the peer review work of scientific articles.

    • Producing statistics on the distribution and volume of reviews per peer reviewer.

    • Associating reviewers' personal data with publications. The names of the reviewers appear on the page of the scientific production once it is published on NumeRev.

  • Managing requests for the right of access, rectification, and opposition.

Only data strictly necessary for the purpose of the processing defined above will be collected. NumeRev collects and processes your personal information to simplify your access to its services. The personal data you provide to the INSTITUTION is not transmitted to external third parties.

3.2 Limitation and Relevance

NumeRev commits to limiting data collection to what is strictly necessary for the intended processing purpose, without which the platform's service could not be provided qualitatively.

The email addresses of reviewers will not be disclosed on the NumeRev interface. An internal tool allows the COLLECTION and the USER to communicate without revealing contact addresses.

3.3 Data Retention

The collected data will be retained for as long as the publication is online.

Deleting a USER account will not result in the deletion of content already published on the NumeRev platform.

Since the GTC are of indefinite duration, either party may terminate them at any time by sending a registered letter with acknowledgment of receipt (RAR), respecting a three-month notice period. At the end of this period, the GTC will be terminated by right without the need for judicial confirmation or decision.

In the event that the COLLECTION opposes the continuation of the publication on NumeRev, it will be considered extinguished. NumeRev commits to maintaining the articles disseminated up to that point, to continue making them accessible to internet users, and to clearly indicate this interruption. This measure ensures the citability of published scientific productions and preserves the long-term investments made by the INSTITUTION in financing NumeRev.

3.4 Your Rights Regarding Your Data

Any modification of personal data is the USER's right. NumeRev commits to informing the USER that they have the right to access, rectify, limit, and delete their personal data. They also have the right to object to the processing of their data at any time.

They can exercise their rights by contacting the Data Protection Officer (DPO) of the Université de Montpellier Paul-Valéry at the following address: dpo@univ-montp3.fr.

If the USER believes that their rights are not being respected, they can file a complaint with the CNIL, online at https://www.cnil.fr/fr/particulier or by mail at the following address: 3 place de Fontenoy - TSA 80715 - 75334 PARIS Cedex 07.

3.5 Security

NumeRev implements all useful technical and organizational measures in light of the nature of the personal data you entrust to us and the risks presented by their processing—to preserve the security of your data and prevent it from being distorted, destroyed, damaged, or accessed by unauthorized third parties.

To this end, we implement technical measures such as firewalls; organizational measures such as a system of unique usernames and passwords for each of our internal or external collaborators; physical protection means, etc.

The site has an SSL certificate to ensure that the information and data transfer via the site are secure.

An SSL ("Secure Socket Layer") certificate aims to secure the data exchanged between the USER and the site.

The host provides a website security service. It works jointly with NumeRev to ensure service quality and the protection of content and data.

ARTICLE 4: INTELLECTUAL PROPERTY

Participation in the NumeRev portal does not confer any intellectual property rights to the COLLECTION.

Digital data, as well as the NumeRev database and platform, are and remain the property of the INSTITUTION. Digital data refers to:

  • digitized data from the collection (layouts, texts, illustrations, and audiovisual materials that may be protected by copyright);

  • files retroconverted from pre-press or PDF files of the COLLECTION;

  • metadata that enables the exploitation of digitized data.

The COLLECTION may, under its control and at its own expense, reuse the digital data it has produced through the NumeRev platform, in accordance with the legal provisions in force.

The COLLECTION authorizes the INSTITUTION to use and reuse the digital data it produces to promote its content and feed the interdisciplinary knowledge management system of the NumeRev platform.

As part of the reuse of digital data, the COLLECTION assigns, on a non-exclusive and gratuitous basis, worldwide, the copyrights including:

  • The right of reproduction, including material fixation procedures for publications, particularly through printing, photocopying, mechanical, optical, or magnetic recording, allowing the communication of publications to the public indirectly on digital and electronic media, particularly via communication networks, including websites, intranets, detachable formats (e.g., PDF, ePUB), web services.

  • The right of representation concerning any direct communication to the public, dissemination of publications via the NumeRev platform, by digital and electronic means, particularly through digital networks, cable retransmission, on digital and electronic media, and in formats (e.g., XML, HTML, PDF, ePUB...) as detachable files.

  • The right to translate metadata into the USER's language to improve the USER experience on the NumeRev platform.

This assignment is made for the entire duration of copyright protection under both French law and international conventions.

The COLLECTION must formally ensure the authors' agreement for online publication. It must also ensure that the holders of the rights authorize the online publication of multimedia files. It is responsible for obtaining the necessary permissions for online publication from the rights holders of the published documents.

The COLLECTION declares and guarantees that the content of the publications is not subject to any exclusivity granted to another publisher with the same activity as the NumeRev platform.

The COLLECTION commits to informing the INSTITUTION in writing of any claim or dispute regarding the rights to the online publication of one of the publications so that the INSTITUTION can remove the content as soon as possible.

In any case, the COLLECTION guarantees the INSTITUTION against any infringement action and/or third-party claim regarding the works. In this scenario, the COLLECTION commits to indemnifying the INSTITUTION against any conviction that may be pronounced against it in the context of legal proceedings and will bear all procedural costs, including attorney fees.

Furthermore, distinctive signs such as domain names, trademarks, names, and logos appearing on the NumeRev platform are protected by the Intellectual Property Code. Any total or partial reproduction of these distinctive signs made from the elements of the platform without the express authorization of the INSTITUTION is not permitted. It is recalled, in accordance with Article L122-5 of the Intellectual Property Code, that the USER who reproduces, copies, or publishes protected content must cite the author and the source.

ARTICLE 5: DISSEMINATION

5.1 Dissemination

The COLLECTION explicitly authorizes the INSTITUTION to:

  • Freely, gratuitously, and without restriction, make available the metadata of all documentary units hosted by the NumeRev platform under these GTC, in accordance with the legal provisions in force.

  • Freely, gratuitously, and without restriction, make available the full text of documentary units on the NumeRev platform.

  • Freely and gratuitously disseminate on the internet the metadata associated with documentary units, in accordance with the legal provisions in force.

  • Translate or have the work translated into all languages and adapt or have the work adapted while respecting the moral rights of the author and the provisions of these GTC.

  • Disseminate and reuse all published resources produced by the COLLECTION to promote the COLLECTION and the research actions of the NumeRev platform.

  • Assign permanent identifiers (DOI) to the articles of the COLLECTION.

These authorizations are granted for the entire legal duration of intellectual property rights protection and remain valid after the expiration or termination of these GTC, except in cases where withdrawal is legally required.

The INSTITUTION will do its best to reference and promote the COLLECTION by all means at its disposal, particularly towards reference databases. The INSTITUTION may grant access to texts, metadata, and COLLECTION covers to external operators for indexing purposes. Internet users will thus be able to access this content by clicking on hyperlinks on partner sites and portals.

5.2 Promotion

Links to the COLLECTION's website will appear on the NumeRev platform. The names of the COLLECTION will be mentioned on the promotional materials produced by the NumeRev platform. The COLLECTION commits to mentioning the name "NumeRev" and the address of the NumeRev platform on the COLLECTION's website and on the printed versions of the COLLECTION to be published.

The COLLECTION authorizes the INSTITUTION to use all information and communication tools deemed useful to promote the NumeRev platform and the COLLECTION without prior agreement.

Any communication involving the NumeRev platform must explicitly mention the name of the platform, the names of the INSTITUTION, as well as the names of the holders of the associated moral rights.

5.3 Hypertext Links

Hypertext links may be present on the site. The USER is informed that by clicking on these links, they will leave the NumeRev platform. The INSTITUTION has no control over the web pages to which these links lead and cannot, in any case, be held responsible for their content.

ARTICLE 6: LIABILITY

All documents published online by the COLLECTION are under the editorial and legal responsibility of its Publication Director, particularly textual, visual, or audio content, including discussion lists, forums, and metadata.

The COLLECTION guarantees, in this capacity, the INSTITUTION that the content complies with current legislation and commits to indemnifying the INSTITUTION against any claim and conviction concerning any of the content published online as part of discussion lists, forums, and metadata.

The sources of the information disseminated on the NumeRev platform are deemed reliable, but the site does not guarantee that they are free from defects, errors, or omissions.

The information provided is for indicative and general purposes only and does not have contractual value. Despite regular updates, NumeRev cannot be held responsible for changes in administrative and legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained on this site.

The USER ensures that their password remains secret. Any disclosure of the password, in any form, is prohibited. They assume the risks associated with the use of their username and password. The site declines all responsibility.

NumeRev cannot be held responsible for any viruses that may infect the USER's computer or any IT equipment following use, access, or download from this site.

The site's liability cannot be engaged in the event of force majeure or an unforeseeable and insurmountable act by a third party.
